A 401(k) administrator administers an employer's retirement plan. Due to the extensive list of duties and the associated hazards, this function is generally delegated to an outside administrator (TPA). Most likely, you're also familiar with the phrase "fiduciary." In legal and financial contexts, fiduciaries are those entrusted to care for another's property or cash. While other types of fiduciaries may be involved with a retirement plan, we will focus on administration fiduciaries here.

The day-to-day operations of the Plan are the responsibility of a 3(16) fiduciary who is held legally accountable under ERISA. Many third-party administrators (TPAs) will handle administrative tasks but not assume any responsibility or liability under section 3(16) because they are not fiduciaries.
